Universities obliged to comply with CNU decisions under Article 20.9 of the Universities Law

Caracas Daily Journal (Vincent Bevins): The National University Council has again affirmed that they hold the right to set the mechanisms for University admission. On Wednesday, Rector Luis Acuña said that rectors who refused to comply would face sanctions. The proposed changes, especially eliminating internal exams in university departments has sparked resistance from some universities.

Of course, if they had wanted the exams eliminated, they would have done so long ago. He added Wednesday that though the Ministry of Higher Education may have presented certain proposals, it is the CNU that actually manages their implementation.

The universities are obligated, according the Article 20.9 of the law of the universities to comply with the decisions made by the CNU. Therefore he has claimed that the positions taken by various rectors are not binding if they do not correspond to those of the CNU.

The new admissions programs, proposed by Chávez' supporters, seek to reduce the level of class exclusion in the universities. The internal exams are seen by Chávez and others as a major obstacle to this effort.

"It would be quite unfortunate that they have rejected a decision, because the law obliges rectors to obey the decision of the CNU," Acuña said. "I still believe that the rectors are sensible people and therefore should understand that the Ministry is looking for an answer for the people, and that we are proposing to do it together with them."
